In plain words. CapSoccer is free to play. Be decent to other players, don’t cheat or abuse the online features, and don’t publish content you shouldn’t. We can remove content and block misuse. The game is provided as is.
1. Agreement
These terms are an agreement between you and NextGen Coders (“we”) for the CapSoccer apps, online services and website (together, the “Service”). By installing or using CapSoccer you agree to them and to our Privacy policy and Community guidelines. If you do not agree, do not use the Service. If you are under the age of majority where you live, a parent or guardian should agree on your behalf.
2. Licence to use the game
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use CapSoccer on devices you own or control, for your own non-commercial entertainment. The game, its code, artwork, sounds, names and logos belong to us or our licensors. You may not copy, modify, reverse engineer, decompile or resell the game, extract its assets, or use it to build a competing product, except where the law gives you that right.
3. Free to play
CapSoccer version 1 is free and has no in-app purchases. We may add optional paid items or advertising in a later version; if we do, the terms and privacy policy will be updated first and you will see the details before you pay or consent.
4. Fair play and conduct
When you use online or community features you agree not to:
- cheat, exploit bugs, modify the app, or use bots, scripts or tools to gain an unfair advantage or to automate publishing, voting or reporting;
- harass, threaten or abuse other players, or use names or levels that are hateful, sexual, violent, or that impersonate others;
- attack, overload, probe or try to gain unauthorised access to our servers or other players’ devices;
- vote-manipulate, spam, or publish levels designed to mislead (for example, advertising other products or sharing personal information);
- break the law or infringe anyone’s rights.
5. Your content (levels and names)
You keep ownership of the Trick Shots levels you create and of your player name. By publishing a level to the community you give us a worldwide, free, non-exclusive licence to host, display, copy and distribute it inside CapSoccer so other players can play, vote on and report it. A published level is locked and can only be removed by deleting it. You confirm that you created it, that it does not infringe anyone’s rights, and that it follows the Community guidelines.
We do not review every level before it appears. A level is accepted only if the game’s own checks show it can be beaten, names pass an automatic filter, and players can report content: three reports from different installs hide a level automatically. We may hide or delete any content, and block an install from the community, at our discretion and without notice, for example for breaking these terms.
6. Online services
Online play and community features depend on our servers and your connection. We try to keep them available but we do not promise they will always work, be free of delay, or never lose a match in progress. We may change, pause or stop any online feature, with or without notice, for example for maintenance or if a feature is misused. Rooms and matches are temporary and are not stored.
7. Third-party platforms
Apple. If you download CapSoccer from the Apple App Store: these terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app, and is not responsible for claims relating to it, including product liability, legal or regulatory compliance, or intellectual property claims. If the app fails to conform to a warranty, you may tell Apple, who will refund the purchase price (if any), and, to the extent the law allows, Apple has no other warranty obligation. You confirm you are not in a country subject to a US embargo or on a US list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also comply with the terms of your wireless service provider and any other third-party agreements that apply when you use the app.
Google. If you download CapSoccer from Google Play, Google’s Terms of Service and Google Play terms also apply to your download. Google is not responsible for support or maintenance of the app.
8. Disclaimer
CapSoccer is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not warrant that the game will be uninterrupted, error-free, or that saved progress will never be lost (for example, if you uninstall the app or change phones). Some places do not allow certain exclusions, so some of this may not apply to you.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for it in the previous 12 months (which is zero for a free game) and 20 euros. Nothing in these terms limits liability that cannot legally be limited, such as for death or personal injury caused by negligence, or fraud.
10. Ending your use
You can stop using CapSoccer at any time by uninstalling it. We may suspend or end your access to online features if you break these terms. Sections that by their nature should survive (such as ownership, licences to published content, disclaimers and liability) will survive.
11. Changes
We may update these terms as the game changes. When we do, we will change the date above, and for material changes we will tell you in the app. Continuing to use CapSoccer after a change means you accept the new terms.
12. Governing law
These terms are governed by the laws of the country where NextGen Coders is established, without regard to conflict-of-law rules, and the courts of that country have jurisdiction, except that consumers keep any mandatory rights they have under the law of the country where they live.
